£9750 following a Road Traffic Accident
Kumari Hart Solicitors acted for Mr H who suffered soft tissue injuries to his neck and lower back together with anxiety whilst driving.
Mr H was the driver of a motor vehicle in which he was driving in the outside lane of a motorway when another vehicle, which was travelling too fast, collided into the rear of his vehicle causing his vehicle to spin. All airbags were deployed, and Mr H feared for his life and that of his 17 year old son in the front passenger seat.
He initially paid for physiotherapy treatment himself, hoping that his would make a recovery thereafter. However, his symptoms persisted, so much so that they started to infringe upon his every day activities and hobbies such as going to the gym and swimming. He felt anxious as he was previously a very fit person, having been in the army. He came to Kumari Hart Solicitors some ten months after the accident.
After statements were obtained, liability for the accident was admitted early on. A GP report was obtained after which an interim payment was obtained to help fund further physiotherapy treatment and a scan. Fortunately, Mr H being of a stoical disposition did not take time off work therefore he did not suffer any loss of earnings.
A schedule of loss was prepared which set out his financial losses and once his medical prognosis was clear, settlement negotiations were commenced. Mr H was able to recover all the physiotherapy treatment costs, his travel expenses, prescription charges and damage to clothing that occurred at the time of the accident. Initial low offers from the other party’s Insurer were rejected and the claim eventually settled for £9750.
Mr H was not going to make a claim when the accident first happened, however due to his ongoing symptoms he changed his mind. Had he not done so he would have been left considerably out of pocket. We were able to provide him with the peace of mind that with 20 years of experience in dealing with Personal Injury claims, he was in excellent hands. We took all the worry and stress away from him so that he could concentrate on his recovery.
